But it is much more\u2013which can lead to your success as a leasing agent in Dubai.&nbsp;<\/p>\n\n\n\n<p><strong>Here is some rental terminology you should be familiar with:&nbsp;<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-table is-style-stripes\"><table><tbody><tr><td><a href=\"https:\/\/www.bayut.com\/mybayut\/rera-guide\/\" target=\"_blank\" aria-label=\"undefined (opens in a new tab)\" rel=\"noreferrer noopener\">RERA<\/a> (Real Estate Regulatory Authority)&nbsp;<\/td><td>A government agency with full legal authority to regulate the real estate sector in Dubai. <\/td><\/tr><tr><td>RDSC (Rental Dispute Settlement Center)&nbsp;<\/td><td>A government committee which oversees rent disputes between landlords and tenants.&nbsp;<\/td><\/tr><tr><td>Ejari<\/td><td>A registration system in Dubai by the Land Department for tenancy agreements.<\/td><\/tr><tr><td>DEWA (Dubai electricity and water department)<\/td><td>The sole electricity and water supplier in Dubai<\/td><\/tr><tr><td>Rent Cap&nbsp;<\/td><td>The maximum percentage increase in rents in a given time period.<\/td><\/tr><tr><td>Rental Index&nbsp;<\/td><td>Created by RERA, Rental Index gives a price range for rents based on location and number of bedrooms.&nbsp;<\/td><\/tr><tr><td>Rental Yield<\/td><td>Rental income a property can generate per year by comparing achievable rent and property value.&nbsp;<\/td><\/tr><tr><td>Lease&nbsp;<\/td><td>A written agreement between the owner of a property and the occupant.<\/td><\/tr><tr><td>Sub-lease&nbsp;<\/td><td>Re-renting of a property by an existing tenant to a new third party for a portion of the tenant\u2019s existing lease contract.&nbsp;<\/td><\/tr><tr><td>Tenant&nbsp;<\/td><td>The individual who occupies a property lease.<\/td><\/tr><tr><td>Landlord<\/td><td>The owner of a property&nbsp;<\/td><\/tr><tr><td>White Goods<\/td><td>Large electrical appliances used domestically, such as refrigerator, cooker, dishwasher and washing machine<\/td><\/tr><tr><td>Snags&nbsp;<\/td><td>Defects or a problem that exists in a property after the construction is completed.<\/td><\/tr><tr><td>Wear and Tear<\/td><td>The amount of damage or wear that could be reasonably expected through ageing and the normal use of your property<\/td><\/tr><tr><td>Security Deposit<\/td><td>An amount of money that is given to the landlord of a property as proof of intent to move in and care for the property<\/td><\/tr><tr><td>District Cooling&nbsp;<\/td><td>Centralised production and distribution of cooling energy that provides buildings&nbsp;<\/td><\/tr><tr><td>Home Orientation&nbsp;<\/td><td>First tour of the property once its near completion.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2>Rental Laws In Dubai<\/h2>\n\n\n\n<p>Let\u2019s look at<a href=\"https:\/\/www.bayut.com\/mybayut\/rera-tenancy-laws-dubai\/\" target=\"_blank\" aria-label=\"undefined (opens in a new tab)\" rel=\"noreferrer noopener\"> RERA&#8217;s&nbsp;tenancy laws<\/a> that govern the leasing market in Dubai:&nbsp;<\/p>\n\n\n\n<ul><li><strong>Law No. (26) of 2007<\/strong>: Regulates the relationship between landlords and tenants in Dubai.<\/li><li><strong>Law No. (33) of 2008<\/strong>: Amended certain articles of the Law No. (26) of 2007 and also governs the landlord-tenant relationship in Dubai. Let&#8217;s take a look at their differences.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td>SHORT-TERM RENTALS&nbsp;<\/td><td>LONG-TERM RENTALS&nbsp;<\/td><\/tr><tr><td>Leasing out a furnished property based on a short-term basis&nbsp;<\/td><td>Leasing out a furnished or unfurnished property on a long-term basis<\/td><\/tr><tr><td>Rented out daily, weekly or monthly&nbsp;<\/td><td>Rented out yearly<\/td><\/tr><tr><td>Maximum time-period is six months&nbsp;<\/td><td>Minimum time-period is six months<\/td><\/tr><tr><td>Utilities connected (electricity, water, internet, air-conditioning, gas)<\/td><td>Excludes utilities&nbsp;<\/td><\/tr><tr><td>Governed by DTCM (The Department of Tourism and Commerce Marketing)<\/td><td>Governed by RERA (Real Estate Regulatory Authority)<\/td><\/tr><tr><td>Tenants do not require a residency visa<\/td><td>Tenants require a valid residency visa<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>So, what exactly does the rental process look like for an agent? It is as follows:&nbsp;<\/p>\n\n\n\n<ol><li>Look for inventory<\/li><li>View the property\u00a0<\/li><li>Advertise the property on Bayut and <a aria-label=\"undefined (opens in a new tab)\" href=\"https:\/\/dubai.dubizzle.com\" target=\"_blank\" rel=\"noreferrer noopener\">dubizzle<\/a>*<\/li><li>Arrange for viewings with potential tenants<\/li><li>Submit the potential tenant\u2019s offer to the landlord\u00a0<\/li><li>Create tenancy contract &#8211; you can create tenancy contracts on Profolio\u2122 with all the details filled in from the listing.<\/li><li>Have both parties sign the tenancy agreement<\/li><li>Assist with Ejari registration\u00a0<\/li><li>Assist with <a aria-label=\"undefined (opens in a new tab)\" href=\"https:\/\/www.bayut.com\/mybayut\/how-get-move-permit-dubai\/\" target=\"_blank\" rel=\"noreferrer noopener\">move-in permit<\/a><\/li><\/ol>\n\n\n\n<p>*When advertising your property on Bayut, use Profolio\u2122\u2019s quality listing metres to ensure that your listing is<a aria-label=\"undefined (opens in a new tab)\" href=\"https:\/\/www.bayut.com\/agentportal\/3-steps-to-creating-quality-listings\/\" target=\"_blank\" rel=\"noreferrer noopener\"> high quality<\/a>, or green colour.\u00a0<\/p>\n\n\n\n<p>A quality listing:&nbsp;<\/p>\n\n\n\n<ul><li>Has a title of 40-80 characters<\/li><li>Has a description of a minimum of 300 characters<\/li><li>Has the required number of photographs (based on property type)<\/li><li>Has a <strong><a aria-label=\"undefined (opens in a new tab)\" href=\"https:\/\/www.bayut.com\/agentportal\/announcements\/floor-plans-mandatory-to-get-a-perfect-quality-score\/\" target=\"_blank\" rel=\"noreferrer noopener\">Floorplan<\/a><\/strong> assigned (available on Profolio\u2122)<\/li><\/ul>\n\n\n\n<h2 id=\"documents-req\"><strong>Documents Required<\/strong><\/h2>\n\n\n\n<p>To register a property being rented out, you must obtain documents from the landlord and the tenant. Here are the documents you&#8217;ll need for a&nbsp;<strong>tenancy contract<\/strong>:&nbsp;<\/p>\n\n\n\n<ol><li>Emirates ID of the occupant<\/li><li>Documents from the landlord: Title Deed, landlord\u2019s passport copy with the signature page, Final Electricity and water bill<\/li><li>Documents from the tenant (individual): Tenant\u2019s passport copy, tenant\u2019s Emirates ID copy, a UAE bank account&#8217;s chequebook\u00a0<ol><li>Documents from the tenant (if the tenant is a company): Trade licence, passport copy of the authorised signatory, passport copy of the occupant, Emirates ID of the occupant<\/li><\/ol><\/li><\/ol>\n\n\n\n<p>The following documents are required for <strong><a href=\"https:\/\/www.bayut.com\/mybayut\/how-to-register-ejari-complete-guide\/\" target=\"_blank\" aria-label=\"undefined (opens in a new tab)\" rel=\"noreferrer noopener\">Ejari<\/a> registration<\/strong>:&nbsp;<\/p>\n\n\n\n<ol><li>From the landlord: Title Deed, landlord\u2019s passport copy with the signature page<\/li><li>From the tenant: Tenant\u2019s passport copy, Tenant\u2019s Emirates ID copy<\/li><li>From both parties: Original signed tenancy contract, DEWA premise number (9 digits)<\/li><\/ol>\n\n\n\n<h2><strong>Notice Period For Renewals<\/strong><\/h2>\n\n\n\n<p>A notice must be given by the landlord or the tenant regarding renewals, rent increases and evictions. This is governed by the RERA\u2019s <strong>Law No.<\/strong> (<strong>33) of 2008. <\/strong>Here are some things to keep in mind:&nbsp;<\/p>\n\n\n\n<ol><li>Notice period for renewals: Must be given by either party 90 days before the expiry of the lease<\/li><li>Notice period for rent increases: Must be given to the tenant 90 days before the expiry of the lease term\u00a0<\/li><li>Notice period for eviction: Must be given 12 months in advance by the landlord for the eviction upon expiry of the lease period.\u00a0<\/li><\/ol>\n\n\n\n<p>(or)&nbsp;<\/p>\n\n\n\n<p>Must be given 30 days in advance by the landlord for eviction during the lease term, if the tenant breaches the terms of the tenancy contract.&nbsp;<\/p>\n\n\n\n<h2 id=\"evictions-dubai\"><strong>Evictions<\/strong><\/h2>\n\n\n\n<p>An eviction is the legal removal of the tenant from the rental property by the landlord. Here are the legalities of eviction you need to know:\u00a0<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img width=\"1024\" height=\"640\" src=\"https:\/\/www.bayut.com\/agentportal\/wp-content\/uploads\/2022\/09\/Help-I-am-new-to-rentals-_-Body-2-14-9-22-1024x640.jpg\" alt=\"evictions\" class=\"wp-image-16718\" srcset=\"https:\/\/www.bayut.com\/agentportal\/wp-content\/uploads\/2022\/09\/Help-I-am-new-to-rentals-_-Body-2-14-9-22-1024x640.jpg 1024w, https:\/\/www.bayut.com\/agentportal\/wp-content\/uploads\/2022\/09\/Help-I-am-new-to-rentals-_-Body-2-14-9-22-300x188.jpg 300w, https:\/\/www.bayut.com\/agentportal\/wp-content\/uploads\/2022\/09\/Help-I-am-new-to-rentals-_-Body-2-14-9-22-768x480.jpg 768w, https:\/\/www.bayut.com\/agentportal\/wp-content\/uploads\/2022\/09\/Help-I-am-new-to-rentals-_-Body-2-14-9-22-640x400.jpg 640w, https:\/\/www.bayut.com\/agentportal\/wp-content\/uploads\/2022\/09\/Help-I-am-new-to-rentals-_-Body-2-14-9-22.jpg 1440w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<h3><strong>Evictions During the Lease Term<\/strong><\/h3>\n\n\n\n<p>In Dubai, the legal reasons for evictions during a lease term include:&nbsp;<\/p>\n\n\n\n<ol><li>If the tenant fails to pay the rent within 30 days of notification from the landlord<\/li><li>If the tenant sub-leases the property without the permission of the landlord\u2019s consent<\/li><li>If the tenant uses the premises illegally or immorally&nbsp;<\/li><li>If the premise is deemed dangerous and likely to collapse, after receiving a technical report from the Dubai Municipality<\/li><li>If the competent authority needs to demolish the building as part of urban development<\/li><\/ol>\n\n\n\n<p>In this case, the landlord must notify the tenant in writing through Notary Public or Registered Mail, within 30 days&nbsp;<\/p>\n\n\n\n<h3><strong>Eviction notice at the expiry of the lease term&nbsp;<\/strong><\/h3>\n\n\n\n<p>The landlord may demand eviction of the tenant after the expiry of the lease term. Reasons for eviction, in this case, are as follows:<\/p>\n\n\n\n<ol><li>If the landlord wants to sell the property&nbsp;<\/li><li>If the landlord wants to recover the premise for personal use or by next of kin (of the first degree)<\/li><li>If the property requires demolition or major renovation (requires approval of the Dubai Municipality)<\/li><\/ol>\n\n\n\n<p>In this case, the landlord must notify the tenant in writing through Notary Public or Registered Mail. The notice period for this eviction is 365 days.&nbsp;&nbsp;<\/p>\n\n\n\n<h3><strong>Important Notes On Eviction&nbsp;<\/strong><\/h3>\n\n\n\n<ol><li>If eviction has been granted for personal use, the property cannot be leased: 2 years for residential units and 3 years for commercial units<\/li><li>If eviction is not granted, the tenant has the automatic right to renewal\u00a0<\/li><\/ol>\n\n\n\n<h2><strong>Guidelines On Rental Increase&nbsp;<\/strong><\/h2>\n\n\n\n<p>The RERA rental index groups properties based on the unit&#8217;s types, locations and sizes. Rental increases are permitted for properties with a current rent below 90% of average rent.<\/p>\n\n\n\n<p>You can find the rental index on the <a href=\"https:\/\/www.bayut.com\/mybayut\/dubai-land-department-dld-guide\/\" target=\"_blank\" aria-label=\"undefined (opens in a new tab)\" rel=\"noreferrer noopener\">DLD\u2019s<\/a> Rental Index page, or Dubai REST Smart App: <a href=\"https:\/\/dubailand.gov.ae\/en\/eservices\/rental-index\/rental-index\/#\/\">https:\/\/dubailand.gov.ae\/en\/eservices\/rental-index\/rental-index\/#\/<\/a><\/p>\n\n\n\n<p><strong>Rental Increase Guidelines&nbsp;<\/strong><\/p>\n\n\n\n<p>An increase in rent is regulated by the Rental Index set by RERA.\u00a0<\/p>\n\n\n\n<ul><li>If the rent is less than 10% less than the average rental value of similar units, the landlord cannot increase the rent.\u00a0<\/li><li>If the rent is 11 to 20 % less than the average rental value of similar units, the landlord can increase the rent by 5%<\/li><li>If the rent is 21 to 30 % less than the average rental value of similar units, the landlord can increase the rent by 10%<\/li><li>If the rent is 31 to 40 % less than the average rental value of similar units, the landlord can increase the rent by 15%<\/li><li>If the rent is more than 40% less than the average rental value of similar units, the landlord can increase the rent by 20%<\/li><\/ul>\n\n\n\n<p>To calculate rents, the calculation is as follows: <\/p>\n\n\n\n<p>Average rent &#8211; Original rent x 100, divided by the Average Rent<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>At our Bayut Academy workshop, we share interactive exercises for attendees to try their hand at calculating the rental increase of properties. Register for the next session to understand this calculation.<\/p><\/blockquote>\n\n\n\n<h2><strong>Rental Dispute Centre&nbsp;<\/strong><\/h2>\n\n\n\n<p>The RDC, or the Rental Dispute Center, is a judicial system in Dubai that specialises in settling all rental disputes between landlords and tenants in Dubai (excluding DIFC).&nbsp;<\/p>\n\n\n\n<p>The RDC attempts to settle all claims within 75 days.&nbsp;<\/p>\n\n\n\n<h3><strong>Rental Dispute Center Fee<\/strong><\/h3>\n\n\n\n<p>The party filing a dispute can demand financial compensation or eviction.&nbsp;<\/p>\n\n\n\n<p>The party who registers the complaint:&nbsp;<\/p>\n\n\n\n<ul><li>Financial compensation: has to pay 3.5% of the annual rent<\/li><li>Minimum fee: AED 500<\/li><li>Maximum fee: AED 15k<\/li><li>Eviction:&nbsp; Has to pay AED 20k<\/li><\/ul>\n\n\n\n<p><strong>To Be A Rental Legend:&nbsp;<\/strong><\/p>\n\n\n\n<ol><li>Understand all the leasing regulations thoroughly&nbsp;<\/li><li>Update yourself on the market\u2019s performance<\/li><li>Price your inventory correctly<\/li><li>Ensure the property is easily accessible&nbsp;<\/li><\/ol>\n\n\n\n<p>A successful real estate career is a product of consistent learning.
