I am interested to know about the procedure through which Investors who have already paid a few installments to the Developers, where as the project work is yet to start and there are no signs of any possibility of the construction work to begin in the near future.



Under such circumstances what procedure the Investor should adopt to re-claim the money back from the Developer. Especially if the Investor is not residing in UAE, it becomes quite difficult to know about the existing laws of UAE and then proceed with the Developer. The project is Crown Residencia and it is in Emirates city Ajman.

A number of people are going through the same problem, however I believe your first course of action should be to contact ARRA (Ajman Real-Estate Regulatory Authority).

From what I have heard that staff at ARRA is very friendly and more than willing to answer your questions.

Secondly, you should try to get in touch with real estate lawyers if possible and hopefully they should be able to guide you further. The problem with Ajman is that they are not as organized as Dubai and getting answers will take longer than expected.

I am late in the blog but still I would comment on the above. Well like Dubai Ajman also having the Authority like ARRA but for the investors and to protect their rights. Firstly one should get the details pertaining to the registration and all with respect to the units contracted with the Developer. Being a Lawyer in this real sector I have seen both the sides of the investment obviously the brighter and darker ...Approaching ARRA would be part of mediation. The execution power only entrust with the courts. This is true side of such property disputes.

Legally one should put the demand that is what law says (civil).

Then we have the relevant real estate privilege laws. So, in order to get the refund and to protect the investor one should have the record for the payment. Based on this legally we will first put a legal notice through courts towards the defaulter.

Hi Ali,

Mr. Zeeshan has already mentioned that you must contact ARRA (Ajman Real Estate Regulatory Authority) as there are several people facing the same situation in Ajman.

I would also advise you to contact real estate lawyers as they can further guide you in this perspective.
