I bought appartment in Bay Central from Select Group. The actual size of appartment is less then contracted. Contracted size 77m2, actual is 54m2. Totally redesigned entrance. Project delayed for several months. Any advices what I can do? What actions can be taken against Select Group?

Have you taken up the issue with the developer and what is their take on the matter?

It is a violation of the contract but believe me, there are investors out there who have lost their entire investment with developers vanishing with their funds. Its going to be a very long-shot unfortunately if you are going to try to recover your investment. If you haven't paid already then you should try to get the price adjusted as the previous contracts stands void.

Your best bet would be to discuss this matter with a real estate lawyer and evaluate your options before taking any further action.

Hi Zeeshan, thanks for clear answer. I havn't paid the final installment. They are asking me to make final payment to make appartment handed over and then rise the issue with RERA etc. I'm reluctant to do 40% final payment. What if they reluctant to make adjustment to contract? What RERA can do in this regards?

Hi again,

I would seriously advise you to consult with a real estate lawyer and evaluate your options.

As I said before it will be a long shot and an individual complaint at RERA will be like a needle in a haystack. Anyhow you must consider your options before signing the contract.

Sorry haven't been of much help but such matters always require legal advice.
