If they are offering a swap deal of some kind against your property, then you should definitely consider that. There might be a conglomerate of people who have suffered the same wrath and they might be putting there efforts together to get back at the developer. You will need to search on forums and see if there is a group of such people considering to take the issue to the court of law.
